Former bodyguard alleges drugs in Spears’s custody case
A former bodyguard for Britney Spears was the much-hyped “secret witness” in her custody battle with Kevin Federline today. Tony Barretto was prepared to testify about “issues of nudity by Ms. Spears, drug use and safety issues involving the children” that he witnessed as her bodyguard before being fired on May 17, says Barretto’s attorney. Instead of testifying, his written allegations were entered into court as evidence. Spears’s lawyer, Laura Wasser, strongly denied allegations of drug use by her client. “He isn’t a credible witness,” said Wasser after a two-hour closed-door hearing on Monday. The hearing was the last for Wasser, who stated she’s officially stepping aside as Spears’s attorney. Spears’s new lawyer will be Marci Levine. “Britney will be in excellent hands” with Levine, Wasser said. “I don’t want anyone to perceive that we’re dumping Britney,” Wasser added. “In a lot of attorney-client relationships, there comes a time when some fresh blood is necessary.” Wasser also confirmed that Spears and Federline’s current 50/50 custody arrangement for Sean Preston and Jayden James will remain in effect for now. She also added that many of the popstar’s associates have already been deposed after being issued subpoenas to testify about Spears’s parenting skills.
Lindsay gets 1 day in jail
Lindsay Lohan will not stand trial for DUI. The rehabbing actress struck a deal by pleading no contest to two counts of DUI. By law, Lohan is considered a second offender (with two DUIs) and must serve a minimum of four days in jail. Lohan also pleaded no contest to two counts of being under the influence of a controlled substance (two separate incidents) and reckless driving – all misdemeanors. This afternoon a judge ordered Lohan to serve 36 months probation and to attend an alcohol education program for 18 months for the first DUI. As for the controlled substance plea, Lohan was ordered not to use controlled substances and required to enroll in a drug program. She’s also required to stay for an unspecified amount of time at the Utah facility where she’s currently in rehab. As for the second DUI plea, Lohan was ordered to serve four days or 96 hours in jail, but the sentence was reduced to only 48 hours by the end of this afternoon’s hearing. The judge then gave her credit for one day in jail for time already served on the day of her arrest. Lohan must serve the remaining 24 hours by January 18, by which time she must show that she’s successfully completed rehab. The actress was also sentenced to 10 days of community service and ordered “not to associate with people with controlled substances.” Jail is the new black!
Sandra Bullock’s stalker up on two felony charges

The woman who allegedly tried to kill Sandra Bullock‘s husband has been charged with two felony counts. The 56-year-old was charged today with one count of aggravated assault and one count of felony stalking for trying to run over Jesse James with her Mercedes as Bullock and James’s young son watched in horror. If convicted of both counts, the woman faces a maximum sentence of four years and eight months in jail. She is due in court next week.
Sandra gets three-year restraining order
Sandra Bullock was back in court on Friday with a request to extend a restraining order against the woman who tried to run over her husband Jesse James a few weeks ago. “The first [restraining order] was issued on May 2. It expired on May 11…that’s how temporary it was. Today was the hearing to get an extension and a much longer one,” said an Orange County Sheriff spokesperson. Bullock was successful in obtaining a three-year extension on the order. “Three years is a long time. If [the stalker] goes anywhere near Ms. Bullock or her husband you can bet that we will take the proper actions,” said sheriff’s rep.
Ty Pennington busted for DUI
Extreme Makeover host Ty Pennington was arrested early Saturday morning for DUI. The 42-year-old handyman was booked at an LA county jail on a misdemeanor and released a few hours later on $5,000 bail. “I made an error in judgment,” Pennington said in a statement. “We all make mistakes; however, this is about accountability. Under no circumstances should anyone consume alcohol while driving. I could have jeopardized the lives of others and I am grateful there was no accident or harm done to anyone. This was my wake-up call. I want to apologize to my fans, ABC Television and my design team for my lapse in judgment and the embarrassment I have caused.” Pennington is due in court on June 4.
Lindsay’s ex suing unknown MySpace blogger
One-time Lindsay Lohan beau Harry Morton has filed suit against…well, he’s not exactly sure. The Pink Taco chain owner filed papers in LA on Thursday suing a “Jane Doe,” whom he claims posted nude photographs of one of his friends on a MySpace page along with a false statement that the friend had AIDS. Morton claims to have suffered “emotional distress” and “lost business” after the pictures were posted and has been forced to “rehabilitate his reputation.” He is also reportedly working with MySpace.com to identify the Jane Doe.
Anne Hathaway’s beau sued for $55 mil
Real estate developer and Anne Hathaway‘s boyfriend Raffaelo Follieri is being sued for allegedly using $55 million of supermarket billionaire Ron Burkle’s money to lavish “an unnamed actress girlfriend,” according to court papers. In the lawsuit, Burkle claims Follieri spent some portion of the $55 million – which was meant to be used on a development project on land purchased from the Catholic church – on private jet travel for himself and the Devil Wears Prada star, doggy care for their pet Labrador, an executive jet, and shopping at Prada and Fendi. In a statement about the case, Follieri said, “We believe we have conducted our affairs for the joint venture successfully.” Speaking of affairs, Follieri has reportedly been spotted in NYC with an unnamed Roberto Cavalli model while Hathaway has been in LA filming Get Smart. Hathaway’s rep has not commented.
Sandra files for restraining order

Sandra Bullock has officially applied for a restraining order against the woman who attempted to run over her husband. In papers filed in an Orange County court, Bullock says the woman has trespassed on the couple’s property “on several occasion, and threw numerous signs and other objects over the gate.” The woman was arrested a few weeks ago after attempting to run over Jesse James when he asked her to leave the couple’s property. Bullock’s petition also requests protection for James’s three children.
